DAMAGE DISCLOSURE STATEMENT
I certify that, to the best of my knowledge, this vehicle:

wrecked, destroyed or damaged to such an extent that the total estimate, or actual cost, of parts and labor to rebuild or reconstruct the vehicle to the condition it was in before an accident, and for legal operation on the road or highways, is more than 75% of the retail value of the vehicle at the time of the loss. (Checking the "has been" box means the vehicle must have an anti-theft examination before being registered, and that the title issued will have the statement "Rebuilt Salvage: NY" on it.)

For each vehicle, please forward Maggard the following:
  1. Certificate of Title
  2. The original or an acceptable copy of the contract / purchase agreement which is the basis of the right to repossess
  3. The original or an acceptable copy of the notice of repossession and intent to sell delivered in person to the debtor, or sent by registered or certified mail to the last known address of the debtor. If sent by certified mail, the receipt or an acceptable copy must be attached.
    The notice:
    • shall set forth the debtor's rights as to reinstatement of the contract, if the lienholder extends the privilege of reinstatement and redemption of the motor vehicle;
    • shall contain an itemized statement of the total amount required to redeem the motor vehicle by reinstatement or payment of the contract in full;
    • shall give notice to the buyer of the lienholder's intent to resell the motor vehicle at the expiration of 15 days from the date of mailing the notice;
    • shall disclose the place at which the motor vehicle is stored; and
    • shall designate the name and address of the person to whom the buyer shall make payment or upon whom he may serve notice
  4. A copy of the certified mail envelope showing name/address and postage date of the letter of repossession
  5. Bill of sale showing the date of sale, name of purchaser, make and VIN of the vehicle, if the purchaser is not the lienholder
  6. Power Of Attorney for Maggard (if you have not previously submitted one)
